AGENDA

Pursuant to Section 551.071 of the Texas Government Code, the Council may convene into Executive
Session(s) from time to time as deemed necessary during the meeting for any posted agenda item and
may receive advice from its attorney as permitted by law.

3. OATH OF OFFICE FOR NEW CITY COUNCIL MEMBERS

4. CONSENT AGENDA

All matters listed as Consent Agenda are considered to be routine by the City Council and will be
enacted by one motion. There will not be a separate discussion of these items. If discussion is
desired, that item will be removed from the consent agenda and will be considered separately.

5. OPEN FORUM

The City Council invites persons with comments or observations related to city issues, projects, or
policies to briefly address the City Council. Anyone wishing to speak should sign-in with the City
Secretary before the beginning of the City Council meeting. In order to expedite the flow of business
and to provide all citizens the opportunity to speak, there is a three-minute limitation on any person
addressing the City Council. State law prohibits the City Council from discussing or taking action on
any item not listed on the posted agenda.

NEW BUSINESS

6. Discuss, consider, and act on moving July regular city council meeting to July 15, 2019.

7. Discuss and consider amending zoning of property in the city, in particular along FM 407 to provide
more commercial property.

BUDGET WORKSHOP

8. Discuss and consider proposed budget for Fiscal Year 2019.

EXECUTVE SESSION

9. Pursuant to authorization by title 5, Chapter 551, of the Texas Government Code, Section 551.071
consultation between city council and city attorney to seek legal advice from the city attorney
regarding legal issues related to any item on the agenda. In addition, to receive advice from the city
attorney regarding:

A. Pending or contemplated litigation or a settlement offer; or

B. A matter in which the duty of the attorney to the governmental body under the Texas Disciplinary
Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Chapter 551 of the
Texas Government Code.

10. Pursuant to Sec. 551.074, deliberation regarding the appointment, employment, evaluation,
reassignment, duties, discipline or dismissal of a public officer or employee.

11. Discuss, consider and act on necessary items discussed in Executive Session.

I, the undersigned authority, do hereby certify the above notice of the meeting of the City Council of
New Fairview, is a true and correct copy of the said notice that I posted on the official posting place
at New Fairview City Hall, FM 407, New Fairview, Texas, a place of convenience and readily

COUNCIL MEETING
June 17, 2019

The City Council convened into a Special Meeting. The same being open to the public, the 17th
day of June 2019 in the New Fairview City Hall and notice of said meeting giving the time, place
and subject therefore having been posted as prescribed by Article 5 of the Texas Governmental
code, with the following members present:

Mayor Pro Tem Scott Johnson
Councilman Rick White
Councilman Bill Payne
Councilman Charley Stumm
Councilwoman Rebecca McPherson

PRESENT
City Secretary Monica Rodriguez

ITEM NUMBER 1. CALL TO ORDER:

Mayor Wilson called the meeting to order at 7:16 PM.

ITEM NUMBER 2. ROLL CALL:

Roll call with the above-mentioned names present.

ITEM NUMBER 3. OATH OF OFFICE FOR NEW CITY COUNCIL MEMBERS:

Mayor Joe Max Wilson sworn in the members listed below; prior to the start of the meeting.

ITEM NUMBER 4. CONSENT AGENDA:

ITEM NUMBER 5. OPEN FORUM:

Citizen – Wayne Gentry: Rio Rancho – 2014 – we put in a well and have the desire to put in a fruit
orchard. We have a You Tube Channel and putting together a 5-year plan.

Would like to start something in the next year to plant Blackberries and Raspberries. We would like it
to be a city activity to harvest the fruit. We can have the families come out and have the kids pick out
their own. It would be a fun family activity. He wants to make sure it is legal on his 1.2 acres of land.
Also, since his backyard is on FM 407 and there is already a little gate he would like to know if its ok
to use that as an entrance off FM 407.

Council: Must check with TX Dot for the entrance and Zoning to see if this would be allowed on the
property.

ITEM NUMBER 6. NEW BUSINESS:

A. Discuss, consider, and act on moving July regular city council meeting to July 15, 2019.
Move the regular July meeting to July 15, 2019 at 7:00 PM.
Mayor Pro Tem Scott Johnson motioned to move the July 2, 2019 meeting to July 15, 2019.
Motion seconded by Councilwoman McPherson. Motion passed unanimously.

B. Discuss and consider amending zoning of property in the city, in particular along FM 407 to
provide more commercial property.
Mayor Joe Max Wilson: Different zoning – Dossier Property and Keystone – Current commercial
property. Need to discuss different zoning.

ITEM NUMBER 7. BUDGET WORKSHOP:

A. Discuss and consider proposed budget for Fiscal Year 2019.

1. Heard from the tax assessors – we need a final budget.

2. Go through budget packet with council.

3. Consider hourly or salary regarding payroll.

ITEM NUMBER 8. EXECUTIVE SESSION:
