AGENDA
Pursuant to Section 551.071 of the Texas Government Code, the Council may convene into Executive
Session(s) from time to time as deemed necessary during the meeting for any posted agenda item and
may receive advice from its attorney as permitted by law.

All matters listed as Consent Agenda are considered to be routine by the City Council and will be
enacted by one motion. There will not be a separate discussion of these items. If discussion is
desired, that item will be removed from the consent agenda and will be considered separately.
A. Approval of Tax Collection Contract with Wise County.
4. OPEN FORUM
The City Council invites persons with comments or observations related to city issues, projects, or
policies to briefly address the City Council. Anyone wishing to speak should sign-in with the City
Secretary before the beginning of the City Council meeting. In order to expedite the flow of business
and to provide all citizens the opportunity to speak, there is a three-minute limitation on any person
addressing the City Council. State law prohibits the City Council from discussing or taking action on
any item not listed on the posted agenda.

5. Discuss, consider and act on the appointment of two city council members.
6. Discuss, consider, and act on Ordinance No. 2019-02-189 establishing a fee schedule for the City of
New Fairview, Texas, and amending the building permit fee.
7. Discuss, consider, and act on recommendation for delinquent tax collection services.
EXECUTVE SESSION
8. Pursuant to authorization by title 5, Chapter 551, of the Texas Government Code, Section 551.071
closed session consultation between city council and city attorney to seek legal advice from the city
attorney regarding legal issues related to any item on the agenda.
OPEN SESSION
9. Discuss, consider and act on necessary items discussed in Executive Session.

The City Council convened into a Special Meeting. The same being open to the public, the 3rd day
of June, 2019 in the New Fairview City Hall and notice of said meeting giving the time, place and
subject therefore having been posted as prescribed by Article 5 of the Texas Governmental code,
with the following members present:

ITEM NUMBER 1. CALL TO ORDER:
Mayor Joe Max Wilson called the meeting to order at 7:00 PM.
ITEM NUMBER 2. ROLL CALL:
Roll call with the above-mentioned names present.
ITEM NUMBER 3. CONSENT AGENDA:
All matters listed as Consent Agenda are considered to be routine by the City Council and will be

that item will be removed from the consent agenda and will be considered separately. City Attorney Bradley Anderle introduced Consent Agenda.
Consent to items without much discussion and agenda items with action. The city council has established a meeting date for all regular meetings being the first Monday of each month. Any special meetings will be scheduled as needed.
RESOLUTION NO. 2019-R002-088
A RESOLUTION OF THE CITY OF NEW FAIRVIEW, TEXAS ESTABLISHING RULES FOR
MEEETINGS OF THE CITY COUNCIL AND PROVIDING AN EFFECTIVE DATE
A. Approval of Tax Collection Contract with Wise County.
Deadline is September 15, 2019. By September 1, 2019 we will have out tax rate adopted.
Monte Shaw Wise County Tax Assessor/Collector: Every municipality will have the same
agreement. The county will mail all tax statements. The city will authorize the county to contract with a
private legal firm for the collection of delinquent taxes and agree that an additional collection penalty
be added to the tax. The county shall send a notice of delinquency and collection cost as required by
law as part of the per parcel fee. The fee to pay the county per agreement will be $0.61 per parcel per
year not to exceed the actual cost of collection. This is the same collection fee paid by all other entities
to the county.
Mayor Pro Tem Scott Johnson made a motion to consent to approve the contract with Wise
County. Motion seconded by Councilman Rick White. Motion passed unanimously.

Mayor Joe Max Wilson: Appointed Charlie Stumm as one of the council members.
Mayor Pro Tem Scott Johnson motioned to approve the nomination. Motion seconded by
Councilman Rick White. Motion passed unanimously.
Mayor Joe Max Wilson: Appointed Bill Payne as one of the council members.
Mayor Pro Tem Scott Johnson motioned to approve the nomination. Motion seconded by
Councilwoman Rebecca McPherson. Motion passed unanimously.
B. Discuss, consider, and act on Ordinance No. 2019-02-189 establishing a fee schedule for the
City of New Fairview, Texas, and amending the building permit fee.
Establishing Fees: Books have a fee that is not lawful.
Mayor Joe Max Wilson: As of May 21st this bill was signed and went through the Senate.
Discussion: What our cost will be using a square footage calculation instead of valuation.
TML is working on a proposal on how to handle this.
Mayor Pro Tem Scott Johnson: We need to sit down and work on a plan for the fees. We can set up
workshop to discuss fees and get something in place in the next 2 months.
C. Discuss, consider, and act on recommendation for delinquent tax collection services.
Wise County highly recommends and works exclusively with the Attorney Linebarger Firm. Mayor
Pro Tem Johnson made a motion to approve contract for Delinquent tax Collection services with
Linebarger Goggan Blair & Sampson, LLP. Motion seconded by Councilman White. Motion
passed unanimously..
ITEM NUMBER 6. EXECUTIVE SESSION:
Pursuant to authorization by title 5, Chapter 551, of the Texas Government Code, Section 551.071
closed session consultation between city council and city attorney. Meeting may be adjourned into
Executive Session at any time to consult with the city attorney.
City Council went into executive session at 8:06 PM. Back to open session at 8:20 PM.
