STATE OF TEXAS
COUNTY OF WISE
CITY OF NEW FAIRVIEW

THE CITY COUNCIL CONVENED INTO A CITY COUNCIL MEETING , THE SAME
BEING OPEN TO THE PUBLIC, THE 23rd DAY OF MARCH 2020 IN THE NEW
FAIRVIEW CITY HALL AND NOTICE OF SAID MEETING GIVING THE TIME,
PLACE AND SUBJECT THEREFORE HAVING BEEN POSTED AS PRESCRIBED BY
ARTICLE 5 OF THE TEXAS GOVERNMENTAL CODE, WITH THE FOLLOWING
MEMBERS PRESENT:

Pursuant to Section 551.071 of the Texas Government Code, the Council may convene into
Executive Session(s) from time to time as deemed necessary during the meeting for any
posted agenda item and may receive advice from its attorney as permitted by law.

ITEM NUMBER 1. CALL TO ORDER:

Mayor Pro Tem Scott Johnson called the meeting to order at 7:05 PM

ITEM NUMBER 2. ROLL CALL:

Roll call with the above-mentioned names present

ITEM NUMBER 3. OPEN FORUM

The City Council invites persons with comments or observations related to city issues, projects, or
policies to briefly address the City Council. Anyone wishing to speak should sign-in with the City
Secretary before the beginning of the City Council meeting. In order to expedite the flow of
business and to provide all citizens the opportunity to speak, there is a three-minute limitation on
any person addressing the City Council. State law prohibits the City Council from discussing or
taking action on any item not listed on the posted agenda.
No citizen wished to speak.

ITEM NUMBER 4. NEW BUSINESS

A. Discuss, consider and act on possible action approving a Resolution postponing the
May 2, 2020 City of New Fairview Municipal Election until November 3, 2020.
Councilman William Payne asked if anything needed to be mention in regard to Governor
Abbotts speech from earlier this week. Alan then explained that on 3/18/2020 the Governor
suspended section 41.0052A of the Texas Legislation Code, allowing for the postponement of
the municipality elections until November 3, 2020. As well as discuss the letter sent form the
Secretary of States office that explained what the cities had to do in order to in act the
postponement. Alan informed council Resolution includes all four statements required by the
Secretary of State and that Bradley Anderle has reviewed the Resolution and approved it. Alan
as mentioned that as on today March 23, 2020 the Wise County Elections office is advising
that everyone postpone the election until November 3, 2020. He also noted that NISD and
Decatur ISD will be announcing their postponement of the elections until November. Alan
mentions an email from NISD to the Governor negotiating for a July election date rather than
a November date and that if that gets approved, we ask that the earlier date be offered to cities
as well and we should follow. This way the city would not be responsible for the cost of the
elections in its entirety. Councilman Charlie Stumm asked if we should set a date for November
or what until a decision is made for the earlier date in July. Alan stated that we should set the
date for November 3 and request for a special date if it gets approved for the schools.
Councilman Charlie Stumm made a motion to approve a Resolution postponing the May
2, 2020 City of New Fairview Municipal Election to November 3 or to when Wise County
and NISD decides to hold theirs. Motion Second by councilman Payne. Motion passed
unanimously.

ITEM NUMBER 5. ADJOURN

Councilman Charlie Stumm adjourned the meeting at 8:14PM. Seconded by councilman
William Payne. Motion passed unanimously
