COUNCIL MEETING
May 14, 2019
7:00 PM

City of New Fairview

The City Council convened into a Special Meeting. The same being open to the public, the 14th
day of May 2019 in the New Fairview City Hall and notice of said meeting giving the time, place
and subject therefore having been posted as prescribed by Article 5 of the Texas Governmental
code, with the following members present:

Monte Shaw, Wise County Tax Assessor/Collector
Michelle French, Denton County Assessor/Collector

ITEM NUMBER 1. CALL TO ORDER

Mayor Wilson called the meeting to order at 7:15 PM.

ITEM NUMBER 2. ROLL CALL:

Roll call with the above-mentioned names present.

ITEM NUMBER 3. OPEN FORUM

The City Council invites persons with comments or observations related to city issues, projects, or
policies to briefly address the City Council. Anyone wishing to speak should sign-in with the City
Secretary before the beginning of the City Council meeting. In order to expedite the flow of business
and to provide all citizens the opportunity to speak, there is a three-minute limitation on any person
addressing the City Council. State law prohibits the City Council from discussing or taking action on
any item not listed on the posted agenda.
No quorum – Table item for a later date when we get a recommendation from Planning and
Zoning.

ITEM NUMBER 4. NEW BUSINESS:

A. Discuss, consider and act on Hope Valley Estates preliminary plat. Recommendation from
Planning and Zoning.
Mayor Pro Tem Scott Johnson motioned to table the plat until we get recommendation from
Planning and Zoning. Motion seconded by Councilwoman McPherson. Motion passed
unanimously.

B. Discuss, consider and act on setting dates for budget workshops in June and July.
First to be held in June as a budget workshop. Second to be held in July.

C. Discuss, consider and act on Resolution NO. 2019-R002-088 establishing regular meetings for
the City of New Fairview City Council.
Meetings to be held the first Monday of each month. Mayor Pro Tem Scott Johnson motioned to
adopt Resolution NO. 2019-R002-088. Councilman Rick White second the motion. Motion
passed unanimously.

RESOLUTION NO. 2019-R002-088
A RSOLUTION OF THE CITY OF NEW FAIRVIEW, TEXAS ESTABLISHING RUKES FOR
MEETINGS OF THE CITY COUNCIL AND PROVIDING AN EFFECTVE DATE.
Passed and Approved May 14, 2019

D. Discuss, consider and act on Ordinance NO. 2019-01-188 establishing the powers and duties
of the Mayor.
Mayor is the CEO. Authority granted to manage the City, enforce any contracts and any ordinance
given to the council. Councilman Rick White motioned to accept Ordinance NO. 2019-01-88
establishing duties of the Mayor. Mayor Pro Tem Scott Johnson second the motion. Motion
passed unanimously.

ORDINANCE NO. 2019-01-188
AN ORDINANCE OF THE CITY OF NEW FAIRVIEW, TEXAS, ESTABLISHING THE
DUTIES OF THE MAYOR; PROVIDING A SAVINGS CLAUSE; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
Passed and Approved May 14, 2019

E. Discuss, consider and act on Resolution NO. 2019-R003-089 canvassing the results of the
May 4, 2019 election and establishing vacancies on the city council.
No election – No results – 2 Vacant seats. Mayor Pro Tem Scott Johnson motioned to adopt
Resolution NO. 2019-R003-089 to canvas election. Councilwoman Rebecca McPherson second
the motion. Motion passed unanimously.

RESOLUTION NO. 2019-R003-089
A RESOLUTION OF THE CITY OF NEW FAIRVIEW, TEXAS DECLARING THE RESULTS
OF THE GENERAL ELECTION ON MAY 4, 2019, CONCERNING TWO MEMBERS OF THE
NEW FAIRIVEW CITY COUNCIL.
Passed and Approved May 14, 2019

F. Discuss, consider and act on appointment of persons to vacant seats in city council.
No discussion

G. Receive and discuss property tax. 101 Presentation from Monte Shaw, Wise County Tax
Assessor/Collector and Michelle French, Denton County Assessor/Collector.
Michelle French, Denton County Assessor/Collector: Presented the presentation.
Monte Shaw, Wise County Tax Assessor/Collector: 1st year collection for all of the county, starting
this October. Appraiser’s office is for appraisals and Tax Collector is for taxes. Summer’s are
important – certified by July 25, 2019 tax roll. By law, it must be adopted no later than September 30th

ITEM NUMBER 5. WORKSHOP:

A. Discuss all agenda items, future present projects and future agenda items.
First to be held in June as a budget workshop. Second to be held in July. Meetings to be held the first
Monday of each month. Special meetings can be held anytime.

ITEM NUMBER 6. EXECUTIVE SESSION

Pursuant to authorization by title 5, Chapter 551, of the Texas Government Code:

A. Section 551.071: closed session consultation with city attorney to seek
legal advice from the city attorney regarding legal issues related to any item on the
agenda.

B. Section 551.074: deliberation regarding the appointment, employment,
evaluation, reassignment, duties, discipline or dismissal of a public office or employee.
City Council went into executive session at 8:21 PM. Adjourned executive session at 8:35 PM.

ITEM NUMBER 7. ADJOURN:

Mayor Pro Tem Scott Johnson made a motion to adjourn the meeting at 8:20 PM. Motion
seconded by Councilman Rick White. Motion passed unanimously.
