AGENDA

Pursuant to Section 551.071 of the Texas Government Code, the Council may convene into Executive
Session from time to time as deemed necessary during the meeting for any posted agenda item and may
receive advice from its attorney as permitted by law.

In order to expedite the flow of business and to provide all citizens the
opportunity to speak, the mayor may impose a three-minute limitation on any person addressing the
council. Our City Attorney Bradley Anderle will review the new updated law concerning public input.

4. EXECUTIVE SESSION:

Pursuant to authorization by title 5, Chapter 551, of the Texas
Government Code. Section 551.071 closed session consultation with city attorney to discuss
items in agenda if needed. Regular meeting may be adjourned into Executive Session at any time
to consult with city attorney.

● Last CPA charged $11,800.00 – 2015
● Last 4 years TML – Texas Municipal League – free, because included in our city
insurance policy and City Membership with the State Organization.

F. Discuss, consider and act on contract for collection of delinquent municipal court
fines and fees
Monica Rodriguez will lead this discussion

G. Gas Well Set Back – More research is needed before it is discussed again in our
meeting.

H. Masterplan – Future meetings – requires many meetings.

I. Building Permits- More research is needed before it is discussed again in our
meeting.

The City Council convened into a Special Meeting. The same being open to the public, the 7th day
of October 2019 in the New Fairview City Hall and notice of said meeting giving the time, place
and subject therefore having been posted as prescribed by Article 5 of the Texas Governmental
code, with the following members present:

ITEM NUMBER 1. CALL TO ORDER

Mayor Wilson called the meeting to order at 7:07 PM.

ITEM NUMBER 2. ROLL CALL:

Roll call with the above-mentioned names present.

ITEM NUMBER 3. EXECUTIVE SESSION

Pursuant to authorization by title 5, Chapter 551, of the Texas Government Code:

A. Section 551.071: closed session consultation with city attorney to seek
legal advice from the city attorney regarding legal issues related to any item on the
agenda.

B. Section 551.074: deliberation regarding the appointment, employment,
evaluation, reassignment, duties, discipline or dismissal of a public office or employee.
City Council went into executive session at 7:07 PM. Back to open session at 7:31 PM.

ITEM NUMBER 4. OPEN SESSION:

A. Discuss, consider and act on matters discussed in Executive Session.

City Attorney – Bradley Anderle read the new law regarding the governing body relating
to the right of a member of the public to address the governing body of a political
subdivision at an open meeting of the body. House Bill number 2840, which took effect as
of September 1, 2019.

ITEM NUMBER 5. PUBLIC INPUT:

A. Recognize Public input to speak on agenda items:
Limitation of 3 minutes
Address council only when acknowledged
Do not address anyone other than the council

Citizen – Mr. Misner – Stated that the public can address at the beginning, middle and end.

City Attorney – Bradley Anderle – Allowed each member to address the item consideration of the
item.

Citizen – Cindy Poe – Homestead exemption, Roads, Maintenance, who addresses and enforces
the codes, exemptions need to be addressed on taxes on the next agenda.

Fire Chief – David Planky – Discussed the fire department willingness to respond to this area.
Time has passed and door is not closed regarding the fire department discussions.

Citizen – Mrs. Hill – Bad roads on Hilltop Trail, how much does it cost to drop asphalt down
instead of fixing the road, and what have we spent on roads.

ITEM NUMBER 6. CONSENT ITEMS:

Councilwoman McPherson approved consent items. Motion seconded by Councilman White.
Motion passed unanimously.

ITEM NUMBER 7. NEW BUSINESS:

A. Discuss, consider and act on website
City Clerk Brooke Boller lead the discussion regarding the closed website. Image Doctor will be
able to fix all the glitches on the website for about $1,000 if we can get the domain released, Cave
Consulting currently owns everything on our website. We are looking into setting up a Facebook
page.

Consent given to allow City Clerk Boller to move forward with the website and Facebook.

B. Discuss, consider and act on Pioneer Road Development and Process
Barry Hudson, City Planner with Dunaway lead discussions
Pioneer Road is 1.1 miles, that is a gravel section. Fairview Meadows to pave their section when
they build phase 3 and 4; about 9/10’s of a mile. Fairview Meadows and Pioneer Ranch is to
work together. Some sections of the road are covered by the county. County will pay for the
labor and we will pay for the materials.

Councilwoman McPherson – stated that we need to get the roads fixed in our city before we do
anymore roads.

Mayor Pro Tem Johnson – Get the engineers involved and start doing something.

Citizen – Mr. Taylor – this should this have been discussed before – Why now? Moving dirt for 3
months and nothing – it’s a joke – it’s on the city not the developer.

Mayor Wilson – the road needs to be addressed. We can’t control what your neighbors do.
Fairview Meadows is not in our city limits.

Scott Schambacher – development for Pioneer Ranch – Common sense – dedicated road, asphalt
or chip and seal will be good enough.

Citizen – Jessica McKinney – Pioneer safety – asphalt will be killing people in 3 yrs, use safety
when considering.

Citizen – Mrs. Hill – ½ asphalt and ½ concrete – brick it.

Councilman White – Motioned to get with our engineer – possibility of much lower staff to do it –
engineer to asses the road at a cost of no more than $2,500.00 Chris Cha will send a spreadsheet.
Motion seconded by Mayor Pro Tem Johnson.
Motion passed unanimously.

C. Discuss, consider and act on Commercial Property

Barry Hudson, City Planner with Dunaway to lead discussions:
Balance between houses and businesses
Tonight – FM 407, Graham Road, Martindale, and 287
Zoning Property – Process for City to designate?
Later Meetings – 2264, 4717, Judge Road, 4421, etc…
City Planner – Mr. Hudson – land use – zone a 5-acre parcel – land use plan for Graham Road
Master Plan – Workshop to update

Citizen – Jamie – Commercial, roads, railroad crossing
Councilman Stumm – Railroad will not fix the crossing, he has called TX Dot a couple of times –
he will send out the TX DOT number for our area

Citizen – Taylor – we need shoulders on 407

Citizen – Nolan – commons areas – parks in any areas??

City Planner – Mr. Hudson – we have areas for parks but there are so many gas wells – New
Fairview doesn’t have a parks department to maintain a park.

Mayor Pro Tem Johnson – future use map

D. Discuss, consider and act on another extension of time on the application for The Pioneer
Ranch plats. Lead by Bradley Anderle, City Attorney and Barry Hudson, City Planner
City Attorney – Mr. Anderle – requested this afternoon to extend the application to November 4,
2019, for now that is.
Mayor Pro Tem Johnson motioned to extend to November 4th
, 2019.
Motion seconded by Councilman White. Motion passed unanimously.

E. Discuss, consider and act on Financial Audit
Monica Rodriguez, City Secretary and Shauna Blackwell, City Clerk will lead this discussion.

City Clerk Blackwell – called neighboring cities as to which city auditor they use – William (Bill)
Spore came highly recommended by all.
If we put out a request for quotes, then we have to get qualifications.
Mayor Pro Tem Johnson suggested to follow up with Spore. Motion seconded by Councilman
White. Motion passed unanimously.

F. Discuss, consider and act on contract with MVBA for delinquent municipal court fines
Monica Rodriguez, City Secretary will lead this discussion.
MVBA will charge a 30% fee on top of the fine that is due to the city. The contract is for 3 years
and at zero cost to the City of New Fairview.
Mayor Pro Tem Johnson motioned to sign contract. Motion seconded by Councilman White.
Motion passed unanimously.

ITEM NUMBER 8. ADJOURN:

Mayor Pro Tem Johnson made a motion to adjourn the meeting at 10:12 PM. Motion seconded
by Councilman White. Motion passed unanimously
