ORDINANCE NO. _____

 

AN ORDINANCE OF THE CITY OF NEW FAIRVIEW, TEXAS, ESTABLISHING A PLACE SYSTEM FOR THE ELECTION OF COUNCIL MEMBERS; ASSINGING PLACES TO CURRENT COUNCIL MEMBERS; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.

 

WHEREAS, the City of New Fairview, Texas, is a Type A general law municipality located in Wise and Denton Counties, created in accordance with Chapter 6 of the Local Government Code, and operating pursuant to the enabling legislation of the State of Texas; and

 

WHEREAS, historically the Council Members have been elected at large without designations of place; and

 

WHEREAS, the City Council now desires to establish a place system as permitted by Section 21.001 of the Texas Local Government Code.

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NEW FAIRVIEW, TEXAS;

 

SECTION 1. 

 

The legislative and governing body of the City shall consist of a mayor and five (5) council members and shall be known as the “Council of the City of New Fairview.”

 

(a) The mayor shall be elected by a majority vote of the qualified voters voting at the election.

 

(b) The five (5) council members shall be elected to individual places, designated by number (1-5), from the City at large and each shall be elected by a majority vote of the qualified voters voting at the election.

 

(c) The mayor and each council member shall hold the office for a period of two (2) years and until a successor is duly elected and qualified.

 

(d) In each odd numbered year the mayor and two (2) council members, Places 2 and 4, shall be elected.  In each even numbered year three (3) council members, Places 1, 3 and 5, shall be elected.

 

SECTION 2.

 

The council as of the date of enactment of this ordinance are assigned places as follows:

 

Council, Place 1 – Scott Johnson

Council, Place 2 – Charlie Stumm

Council, Place 3 – Rick White

Council, Place 4 – Rebecca McPherson

Council, Place 5 – William Payne

 

SECTION 3.

This Ordinance shall be cumulative of all provisions of ordinances of the City of New Fairview, Texas, except where the provisions of this Ordinance are in direct conflict with the provisions of such ordinances, in which event the conflicting provisions of such ordinances are hereby repealed.

 

SECTION 4.

 

It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs, and sections of this Ordinance are severable, and if any phrase, clause, sentence paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section.

 

SECTION 5.

 

This Ordinance shall be in full force and effect after its passage and publication.
