AGENDA

Pursuant to Section 551.071 of the Texas Government Code, the Council may convene into Executive
Session(s) from time to time as deemed necessary during the meeting for any posted agenda item and
may receive advice from its attorney as permitted by law.

3. OPEN FORUM

The City Council invites persons with comments or observations related to city issues, projects, or
policies to briefly address the City Council. Anyone wishing to speak should sign-in with the City
Secretary before the beginning of the City Council meeting. In order to expedite the flow of business and
to provide all citizens the opportunity to speak, there is a three-minute limitation on any person
addressing the City Council. State law prohibits the City Council from discussing or taking action on any
item not listed on the posted agenda.

First Public Hearing to receive input on 2019 tax year proposed property tax rate for the City
of New Fairview of $0.35 per $100 valuation.

A. Discuss, consider and act on 2019-2020 budget and tax rate for the City of New Fairview

B. Discuss, consider and act on interviews for new employees – legal discussion

C. Discuss, consider and act on changing zoning- legal discussion

D. Discuss, consider and act on permits and fees- legal discussion

E. Discuss, consider and act on changing property zone procedures-legal discussion

F. Discuss, consider and act on road expenditures- legal discussion

7. EXECUTVE SESSION

Pursuant to authorization by title 5, Chapter 551, of the Texas Government Code, Section
551.071 closed session consultation between city council and city attorney to seek legal advice
from the city attorney regarding legal issues related to any item on the agenda.

8. OPEN SESSION

A. Discuss, consider and act on necessary items discussed in Executive Session.

9. ADJOURN

I, the undersigned authority, do hereby certify the above notice of the meeting of the City Council of New
Fairview, is a true and correct copy of the said notice that I posted on the official posting place at New
Fairview City Hall, FM 407, New Fairview, Texas, a place of convenience and readily accessible to the

COUNCIL MEETING
August 26, 2019

The City Council convened into a Special Meeting. The same being open to the public, the 26th
day of August 2019 in the New Fairview City Hall and notice of said meeting giving the time,
place and subject therefore having been posted as prescribed by Article 5 of the Texas
Governmental code, with the following members present:

ITEM NUMBER 1. CALL TO ORDER

Mayor Wilson called the meeting to order at 7:15 PM.

ITEM NUMBER 2. ROLL CALL:

Roll call with the above-mentioned names present.

ITEM NUMBER 3. OPEN FORUM

The City Council invites persons with comments or observations related to city issues, projects, or

Citizen – Nolan: Montana Ct., poor repair for road. If everyone on the court would pitch in then
we could fix the road and would not need taxes.

Citizen – Dave/Jamie: 11 neighbors patching pot holes are not doing the job it is better to take the
time to do it right, base and asphalt, the roads are more horrible during the night because
you can not see the pot holes.

Mayor Wilson: We are aware of the road conditions and we will work on it.

ITEM NUMBER 4. PUBLIC HEARING:

First Public Hearing to receive input on 2019 tax year proposed property tax rate for the City of
New Fairview of $0.35 per $100 valuation.
Opened Public Hearing at 7:15 PM

Citizen – Steve Misner: Sat on council 3.5 years, we didn’t do anything that benefited anyone in
the city; we don’t need any services; I’m surrounded on 3 sides by junk yards;
got tickets and were paid but they were never cleaned up. The tax rate
purposed can never be raised. All cities are postponing their taxes, majority for the
last 2 months in Tarrant and Wise County. It will cost him $1,700.00 per year;
there are people in Chisholm that can not afford taxes.

Citizen – Dennise Berket: A lot of people out here for no tax; there is a lot on fixed income, this
will be a burden. Once the tax is passed the city can not raise.

Citizen – Once the tax is passed the city can not increase.

Citizen – Once tax discount will be on the value; once tax rate is set it will not be frozen.

Citizen – We have a September 9
the second public hearing; they will publish notice of meeting 72 hrs before 7 PM.

Citizen – If passed, bills wil be sent October 1st, 2019.

Citizen – Why do we have to pay 2 deputies? Wise County has to patrol us.

City Attorney, Bradley Anderle – When they work for the city; they don’t work for the county.
They are serving the city during the time we pay them.

Citizen – Why start the taxes so high? Why not $.25?

Councilwoman McPherson – The $.35 is a proposed rate, I don’t agree but the city is growing
and we need help.

Citizen – Homeowners fix roads.

Citizen – Montana Ct. – 11 homeowners put out $500.00 each to fix the road.

Citizen – Steve: Gas compressor station sued the county and won, Wise County has to refund
millions.

Citizen – The city is not responsible for past taxes.

Citizen – Moved out here; don’t care about engineer, contractors and animal control.

Citizen – Steve Misner: The only reason we have a city was to stop Fort Worth from annexing us.

ITEM NUMBER 6. EXECUTIVE SESSION

Pursuant to authorization by title 5, Chapter 551, of the Texas Government Code:

A. Section 551.071: closed session consultation with city attorney to seek
legal advice from the city attorney regarding legal issues related to any item on the
agenda.

B. Section 551.074: deliberation regarding the appointment, employment,
evaluation, reassignment, duties, discipline or dismissal of a public office or employee.
City Council went into executive session at 8:05 PM. Back to open session at 9:02 PM.

ITEM NUMBER 7. NEW BUSINESS:

A. Discuss, consider and act on Ordinance No. 2019-05-192 a Joint Ordinance and Boundary
Agreement between the City of Fort Worth and the City of New Fairview
Copy of Ordinance No. 2019-05-192 a Joint Ordinance and Boundary Agreement handed out to the
attending public.
Councilwoman McPherson motioned to approve Ordinance No. 2019-05-192 a Joint Ordinance
and Boundary Agreement between the City of Fort Worth and the City of New Fairview. Motion
seconded by Councilman Stumm. Motion passed unanimously.

B. Discuss, consider and act on 2019-2020 budget and tax rate for the City of New Fairview
Discussed permit fees received.
Councilman Payne: We can increase our revenue and decrease our tax rate. We need to be as low as
we can be.

Mayor Wilson: Discussed permit fees from other cities around. Permits should cover inspectors and
employees.

C. Discuss, consider and act on interviews for new employees – legal discussion
Setup a group committee for interviews: Mayor Wilson, Councilman Payne, Councilwoman
Rebecca McPherson, City Secretary Rodriguez and Ann Stumm.

Mayor Wilson: We need someone to work on the website, someone to help with accounting and
someone for tickets. We need to discuss salaries. Some will be paid from permits and some
from sales tax.

D. Discuss, consider and act on changing zoning- legal discussion
Councilman Bill Payne: We have to have commercial businesses.

Mayor Wilson: Where do we want the commercial property?

E. Discuss, consider and act on permits and fees- legal discussion

F. Discuss, consider and act on changing property zone procedures-legal discussion

G. Discuss, consider and act on road expenditures- legal discussion

ITEM NUMBER 8. ADJOURN:

Mayor Wilson made a motion to adjourn the meeting at 10:00 PM. Motion seconded by
Councilwoman McPherson. Motion passed unanimously.
