Citation Options
Please note that if you are 16 years old or younger, the Court will automatically set you on the next Court Docket. You will be mailed a Summons to appear at the City of New Fairview Municipal Court with a parent or legal guardian.
A PHONE CALL DOES NOT CONSTITUTE AS AN APPEARANCE.
For all citations, you must appear in person, or by mail on or before the Initial Appearance Date printed on your citation.
You may submit some documents via e-mail for approval, upon approval you will be notified to pay.
Be Advised: Failure to handle your citation in a timely manner may result in an additional charge of Violate Promise to Appear, the issuance of a warrant, denial of vehicle registration, denial of a renewal of your driver’s license, and/or submission of your case(s) to a collection agency where additional fees will be added. Juveniles who fail to appear by the time and date on the citation may have their license suspended. A charge of $50.00 will be assessed for executing or processing a warrant.
Option 1: PAY THE FINE
Full Payment of Fine – Any violation paid online or over the phone will be recorded as a conviction and reported to the State of Texas Department of Public Safety. Full payment will automatically forfeit any right for Defensive Driving or Deferred Disposition for your citation. If you pay your citation before reading your options, it automatically closes your case with a guilty conviction, no changes can be made.
Option 2: DEFERRED DISPOSITION
Deferred disposition is an option to have your citation dismissed and not reported to your driving record. In order to have your citation dismissed, you must complete a 90-day probationary period in which no additional citations are received and satisfy all requirements of the deferral agreement. You must appear on or before your appearance date on your citation.
Terms of Deferred Disposition:
- Plea of guilty or no contest and waiver of jury trial and the right to discovery
- A 90-day probation period (cannot receive any other violations within the probation period)
- Persons under the age of 25 with a moving violation must also complete a Driver’s Safety Course
- Payment of the full fine amount plus the $50.00 special expense fee
- Provide a copy of your Driver’s License and the Deferred Disposition Request form (CDL holders are not eligible)
Eligibility Requirements:
- You possess a valid driver’s license, not a Commercial Driver’s License.
- You are not speeding in excess of 24 mph over the limit, nor in a construction zone.
- Request is made within 10 business days of the citation.
- You are not charged with Alcohol, Drug Paraphernalia, Theft, Assault, Disorderly Conduct, Public Intoxication
Complete Deferred Disposition Request:
- The Deferred Disposition Request form
- Copy of your Class C Driver’s License (CDL holders are not eligible)
- Payment of the full fine amount plus the $50.00 special expense fee
Option 3: DRIVER’S SAFETY COURSE
Terms of Driver’s Safety Course
- Plea of guilty or no contest and waiver of a jury trial and the right to discovery.
- 90 days to complete a 6-hour Driver’s Safety Course and submit proof of such to the court. Order and submit a 3A Certified copy of your Driving Record.
- Pay required fee of $144 for regular zone violations or $169 for school zone violations.
- You will still have to pay the cost of the defensive driving class and the certified Driving Record
Eligibility Requirements
- You are at least 17 years of age
- You must have current liability insurance (with the person who received the citation listed as a driver) and a valid Texas Driver’s License (CDL not eligible)
- You have not taken a DSC with in the last 12 months to dispose of a citation
- You are not charged with speeding in excess of 24 mph over the limit, speeding 95 miles hour or more nor in a construction zone.
- Your request is made within 10 business days of the citation.
Complete Driver’s Safety Course Request:
- The Driver’s Safety Course Affidavit (Affidavit must be signed in front of a notary or court clerk)
- Copy of your valid Texas Driver’s License (CDL not Eligible)
- Copy of your current insurance (with the person who received the citation listed as a driver)
- Payment of $144.00 for regular speeding zones or $169.00 for school zone violations
Failure to Comply with the Terms of the Agreement
If you fail to comply with any of the requirements of the Driver Safety Course option, your case will be set for a Show Cause Hearing. The hearing is your opportunity to speak with the Judge regarding why you failed to comply. If you fail to appear at your hearing, a conviction will be entered.
Option 4: REQUEST A COURT DATE
- You may appear at the court clerk’s office to request a court date, mail in a written request, or submit request via email on or before the Initial Appearance date on your citation.
